About the bill:

This bill: 

  • Updates the 1931 Code of West Virginia, which is a set of laws with rules that everyone in West Virginia has to follow.

  • Adds a new part to the Code about sending write ups on psychiatric or physical disabilities to the Division of Motor Vehicles (DMV) to decide if someone is healthy enough to keep their driver's license.

    • Division of Motor Vehicles (DMV): a state office in charge of rules about driving and vehicles like cars, trucks, and buses.

  • Includes what to consider for someone's ability to keep their driver's license, and which disabilities the Division of Motor Vehicles considers.

  • If this bill passes, 

    • Write ups from professionals with a license to work in health care need to be sent to the DMV, and the DMV has to keep them private.

      • Write ups can only be used in court cases that decide if someone can make their own choices, or if they need extra support to make choices

    • Leaders of official offices in West Virginia have to make sure write-ups are turned in.

    • People or groups who share information about a person's psychiatric or physical disabilities with the Division of Motor Vehicles (DMV) won’t get in trouble for sharing.

    • These changes start on July 1, 2025
