Wages for Disabled People

About the bill:

This bill 

  • Updates specific parts of the 1931 Code of West Virginia, which is a set of laws with rules that everyone in West Virginia has to follow.

  • Gets rid of some parts of that code about how much money disabled people get for doing their jobs.

  • Starts a State "Employment First Policy" to encourage jobs where disabled people work with nondisabled people.

  • Sets up a group to specifically work on creating a State Employment First Policy. The group will include:

    • The person in charge of the Division of Rehabilitation Services (they will lead the group).

      • Division of Rehabilitation Services: A state office in West Virginia that supports disabled youth and adults to work and live in their communities.

    • A disabled person.

    • A family member of a disabled person.

    • Someone from the Department of Education (the people who help run public schools).

    • Someone from Workforce West Virginia (they help people find jobs).

    • Someone from the Bureau for Behavioral Health and Health Facilities (they help people with mental health).

    • Someone from the Bureau for Medical Services (they help people get medical care).

    • Someone from the West Virginia Developmental Disabilities Council (they help disabled people learn and grow).

    • Someone who helps people with disabilities find jobs where they work with everyone else (not just in special workshops just for disabled people).

    • Someone from the West Virginia Center of Excellence in Disabilities (they are experts on disabilities).

    • Someone from Disability Rights of West Virginia (they help protect the rights of disabled people).

  • Lays out how to start the State Employment First Policy.

  • Makes sure disabled people working in nonprofit workshops get paid at least the minimum wage in West Virginia.

  • The goals of this bill are to: 

    • Make sure there is fair pay and better job opportunities for disabled people.

    • Motivate state offices to help with employment.

    • Involve different state offices to do what the policy says.
