About the bill:
If this bill is passed, it will change part of the Code of Georgia about obscenity and similar crimes.
Code of Georgia: These are the rules or laws for the state of Georgia that say what people in Georgia can and cannot do.
Obscenity: Words, pictures, or actions that are very offensive, rude, or inappropriate, especially related to sex or violence.
This bill:
Replaces part of the Code of Georgia about obscene stuff, sending it out, and punishments.
Bans giving out or selling obscene stuff made on a computer that shows a child.
Creates a new crime for doing this, that includes 1-15 years in prison as punishment.
Makes clear what’s considered obscene: “a shameful or morbid interest in nudity, sex, or excretion; The material taken as a whole lacks serious literary, artistic, political, or scientific value; and the material depicts or describes, in a patently offensive way, sexually explicit conduct.”
Sets punishments and probation for those who break the law.
Probation: A punishment for breaking the law where a person does not go to jail but must follow strict rules, like meeting with an officer or staying out of trouble.
Updates another part of the Code about how long people have to go to jail for breaking this law, and punishment.
Considers how to decide how people who use artificial intelligence in certain crimes will be punished.
Artificial Intelligence (AI): Computer programs that can think, learn, and make decisions like a person.
Includes tougher punishments for AI use.
Defines important terms and rules like 'Artificial intelligence system,' 'Child,' and 'Sexually explicit conduct.'
Gets rid of other laws that stop this one from working.
Explains the rules for probation and what people on probation must do.
Adds a new section that defines terms about legal problems with artificial intelligence.
Lists the crimes where AI might be involved in their commission.
Explains how courts will determine if a person is guilty in these specific crimes and using AI.
Requires paperwork if they plan to seek tougher punishments based on AI being involved.
Sets punishments for using AI in these specific crimes, with specific rules depending on how bad the crime is.
Makes the judge decide if a person gets extra punishment for using AI to commit a crime.
If this bill passes into law, these new changes will be called the "Ensuring Accountability for Illegal AI Activities Act."
